Abstract:
With the rapid iteration of artificial intelligence (AI) technologies in recent years, medical generative AI has profoundly and extensively influenced the process and outcomes of medical decision-making, permeating the entire process of clinical diagnosis and treatment. The clinical application of medical generative AI has given rise to new conflicts among the “doctor-patient-machine” triad. The fundamental reason lies in the fact that the traditional informed consent mechanism has become unable to adapt to the current new scenarios of diagnosis and treatment. New challenges have emerged, with typical influencing factors including obstacles for physicians to fully disclose intelligent information, difficulties for patients to judge the scope of authorized informed consent, and the protection failure of personal health information during the judgment process of informed consent. To further safeguard patients’ rights and interests in informed consent, it is necessary to draw on domestic laws and learn from extraterritorial legislative explorations, and propose pathways such as improving the notification procedure, clarifying the authorization division, and ensuring the security of personal health information to construct informed consent rules in medical generative AI, thereby adapting to the application needs in new scenarios.
