Abstract:
The value of ethics in law enforcement and the dialectical relationship between moral obligations and legal obligations determine that default is a legal judgment,and meanwhile an ethical judgment.In the context of informed disconsent,medical default could be resulted from the distorted roles of medical staff by the tensional physician-patient relationship,defects in the informed consent system,and the insufficient protection for the high-risky medical treatment.Therefore,it is in urgent need to strengthen the professionalism construction among medical staff,fully develop the function of hospital ethics committee,and continuously perfect relevant legislations.
